Why is EzriCare Being Sued in Florida for Its Artificial Tears?
Many people use eyedrops in the modern era for all kinds of reasons. Some simply get extremely dry eyes. Others use these eyedrops to help with certain allergies. But whatever the reason might be, no one expects to be infected with harmful bacteria after using these products. Unfortunately, this is exactly what some people in Florida experienced after using a specific brand of “artificial tears.” But what injuries did people suffer? How serious is this issue in Florida? And perhaps most importantly, what can you do if you have suffered injuries while using these kinds of products in Florida?
The EzriCare Lawsuit Summarized
On February 10th of 2023, it was reported that a Florida woman had decided to file a federal lawsuit against both EzriCare and Walmart for manufacturing and selling defective eyedrops that caused her to suffer an allegedly serious bacterial infection. She is not alone, and approximately 50 people have come forward with similar allegations of infection.
The specific bacteria is called Pseudomonas aeruginosa, and an infection is serious enough to be life-threatening. Indeed, at least one person has died while a further five people have suffered varying degrees of blindness.
The eye drops are hurriedly being pulled from shelves after the CDC issued an alert for both healthcare providers and distributors. All consumers have been instructed to immediately stop using the product, while EzriCare has been forced to recall its artificial tears. Delsam Pharma is also recalling another brand of artificial tears for similar reasons.
To make matters worse, this particular strain of bacteria is allegedly resistant to anti-bacterial drugs — making it even more deadly and difficult to treat. This is exactly what the aforementioned Florida plaintiff experienced, and she reports that a round of antibiotics was completely ineffectual. Apparently, the only remaining option was to undergo surgery to eliminate the infection.
It is unclear how many people have suffered infections as a result of these eyedrops. It’s also worth pointing out that the infections have not been definitively linked to the eyedrops, but there is strong evidence that suggests some kind of connection. These eyedrops were never approved by the FDA and apparently underwent little federal regulation before becoming available to the public.
